Client, a Special Agent with the US Department of Justice, received a notice of proposed removal for allegations of misconduct, including false statements and lack of candor. Client was removed from the agency.
Pursuant to a full MSPB appeal hearing, the court issued a decision overturning the removal and not sustaining the allegations of false statement and lack of candor in addition to other allegations of misconduct.
Client is immediately reinstated to his position. The agency appeals the MSPB decision overturning the removal. The full board of the MSPB sustains the initial decision. (May 2024) Appellant receives all relief he is entitled to including full attorney’s fees, costs, and other relief pursuant to the back pay act.
