Client, a Federal Air Marshal with TSA, is investigated by the agency for alleged misconduct. The agency first makes a preliminary determination to suspend Client’s access to access to classified information (otherwise known as top-secret clearance). The agency then makes a final determination to revoke client’s top-secret clearance.
Pursuant to the agency’s decision to make that decision final, an appeal is filed to the Department of Homeland Security, Security Appeals Board (SAB) After submitting briefing and supporting documentation, the Homeland Security SAB overturns TSA’s revocation of client’s clearance.
The agency then subsequently dismisses the underlying misconduct investigation. Client returns to duty.
