Client, a supervisor with the Dep’t of Veterans Affairs, receives a proposed removal from Federal service for alleged misconduct. The agency “mitigates” the proposed penalty from removal to a two grade level demotion.
An appeal is filed with the MSPB challenging the action. Pursuant to the discovery process, the agency seeks settlement. Pursuant to settlement, the agency rescinds the action and reassigns client to a position of his choice at his original grade level.
