Client, a supervisory employee with the Department of Homeland Security, ICE, receives a notice of proposed removal regarding alleged misconduct. A written response is prepared on client’s behalf. An oral reply is conducted with the deciding official. The agency sustains the misconduct allegations and the penalty of removal.
An appeal is filed with the MSPB challenging the removal. During the discovery process, the agency rescinds the action. Client returns to full duty as a supervisory employee.
