Client, an employee with the Department of Veterans Affairs, receive notice of a proposed removal for alleged misconduct. Pursuant to a written response and oral reply with the agency deciding official, the agency removes appellant from federal service.

Appeal filed with the MSPB challenging the removal. During the litigation process, the agency rescinds the removal action, reinstates client to previous position. Client returns to duty with back pay, Attorney’s fees, and all other relief upon reinstatement to the agency. Client returns the full duty without any discipline on record.
